Terms of Service
& Service Agreement.

The agreement between A1 Local (us) and you (the client). By approving an A1 Local website proposal, you agree to these terms and the project details in that proposal.

  • Your proposal confirms one fixed Build Price, the project scope and your monthly payment schedule.
  • Nothing is due before launch. The first build payment starts when you approve the completed site and it goes live.
  • You own your domain, content and brand from day one. The website files become yours after the final build payment.
  • You can leave early by paying the remaining build balance — there is no made-up exit fee.
  • Hosting, security and small updates are included while you pay. Ongoing care after the final payment is optional.

The Service

1.1 Your proposal and scope

Before the full build starts, A1 Local will provide a written proposal or order summary setting out the website scope, fixed Build Price, payment amount, Payment Term, expected inclusions and any approved extras. That document and these terms form the agreement. If there is a conflict about project-specific details, the signed proposal takes priority.

1.2 Standard website service

  • Design and development of the pages and features listed in the approved scope.
  • Responsive implementation for current desktop and mobile browsers.
  • Hosting, SSL, backups, security maintenance and reasonable technical support during the Payment Term.
  • Small everyday content updates during the Payment Term, such as changing contact details, prices or supplied images.

1.3 Work outside the scope

Branding, photography, video, substantial copy rewrites, new pages, restructures, new functionality and other work outside the approved scope are not included unless stated in the proposal. We will quote and seek approval before starting additional work. Unless otherwise agreed in writing, larger changes are billed at $100 per hour + GST.

Build Price and Payments

2.1 Fixed Build Price

Your Build Price is the fixed total shown in your approved proposal. Website examples shown on our public pricing page are illustrations only; your proposal confirms the actual price and scope for your project.

2.2 Standard pricing example

As at the effective date of these terms, our public example for a custom five-page website is a $3,600 + GST Build Price, paid as either $150 + GST per month for 24 months or $100 + GST per month for 36 months. This is an example rather than a quote; your approved proposal controls the actual Build Price, scope and payment schedule.

2.3 Payment Term and start date

The Build Price is divided into the monthly payments and Payment Term shown in your proposal. No build payment is due before launch. The first payment becomes due when you approve the completed website for launch and it is made live on your domain, unless a different start date is agreed in writing.

2.4 Processing and overdue payments

  • Payments are processed through Stripe by card or direct debit on the agreed schedule.
  • Prices are exclusive of GST unless stated otherwise.
  • There is no interest or balloon payment on the standard payment options.
  • If a payment remains overdue for more than 14 days after reasonable reminders, we may suspend the website and included services until the account is brought up to date.

Your Input and Launch Approval

3.1 Content and feedback

You agree to provide accurate business information, content, access and feedback reasonably needed to complete the project. Delays by either party should be raised early so a revised delivery date can be agreed.

3.2 Approval

We will give you a reasonable opportunity to review the website before launch. Your written approval to launch confirms that the website substantially matches the agreed scope, subject to any clearly recorded outstanding items.

Ownership and Transfer

4.1 While the Build Price is being paid

You own your domain name, business name, brand assets and the content you supply. Until the Build Price and any other approved project charges are paid in full, A1 Local owns the website code and grants you a licence to use the website through our hosting service.

4.2 After the final build payment

Once the Build Price and other approved project charges have been paid in full, ownership of the custom website files created for your project transfers to you, excluding third-party software, fonts, stock assets and tools that remain subject to their own licences.

  • You may keep the site with A1 Local on a separately agreed hosting and care plan.
  • You may request an export of the transferable website files and arrange hosting elsewhere.
  • Reasonable transfer assistance beyond providing the files may be quoted separately.

Early Payout and Ending the Service

5.1 Early payout

You may end the Payment Term early by paying the unpaid balance of the fixed Build Price, plus any overdue or separately approved charges. There is no additional early-exit fee. After cleared payment, the ownership and transfer provisions in clause 4.2 apply.

5.2 Ending without paying the build balance

If you stop the service before the Build Price is paid and do not pay the remaining balance, your licence to use the website ends and we may take the site offline. Your domain, supplied content and brand assets remain yours, but the website code does not transfer.

5.3 Hosting after ownership transfers

Hosting and care after the final build payment are optional and will be covered by a separate monthly arrangement. If you do not continue hosting with us, we will provide a reasonable transfer window after payment and may then close the hosted site.

Content, Guarantees and Interruptions

6.1 Your content

You confirm that you have the right to use any text, images, trademarks or other material you provide, and that the information you approve for publication is accurate and lawful. You are responsible for claims arising from material you supplied without the necessary rights.

6.2 Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, restricted or modified.

6.3 Third parties and results

We take reasonable care with hosting and technical maintenance, but internet services can be interrupted by third-party hosting, DNS, payment, email or network providers. We do not guarantee a particular Google ranking, traffic level, number of enquiries or business result.

General Terms

7.1 Changes in writing

Changes to the project scope, Build Price, Payment Term or these project-specific arrangements must be agreed in writing. Email is sufficient for ordinary approvals and variations.

7.2 Jurisdiction

This agreement is governed by the laws of Western Australia, and each party submits to the courts of Western Australia and any courts that may hear appeals from them.

7.3 Portfolio use

Unless you ask us not to in writing, A1 Local may show the completed website in its portfolio and place a small “Designed by A1 Local” credit in the website footer.
